These Terms of Service ("Terms") govern your use of www.theneedlestore.com (the "Site") and any purchases from The Needle Store ("we", "us", "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site or buy from us.

Our Site is hosted on Shopify Inc., but we are the seller and data controller for your purchases.

1. Your Statutory Rights

Nothing in these Terms affects your statutory rights under UK law, including:

  • Consumer Rights Act 2015 (CRA): Goods must be of satisfactory quality, fit for purpose, match their description, and last a reasonable time. If faulty or not as described, you have rights to repair, replacement, price reduction, or refund (full details in our Returns Policy).
  • Consumer Contracts Regulations 2013 (CCR): For online/distance sales, you have a 14-day right to cancel most orders from receipt (details and how to cancel in our Returns Policy). We provide pre-contract information (e.g., total price including taxes/shipping, delivery time, payment methods) before you complete checkout.

These rights are mandatory and override any conflicting Terms.

2. Orders and Acceptance

  • All orders are offers to buy; we accept by sending an order confirmation email.
  • We may refuse or cancel orders (e.g., stock issues, pricing errors, suspected fraud, or if you appear to be a reseller without permission). We will notify you and refund any payment.
  • Prices include VAT where applicable but exclude delivery (shown at checkout). Prices may change without notice before order acceptance.
  • We aim to dispatch within the time stated at checkout (or within 30 days if not specified, per CCR).

3. Payment and Billing

  • Payment is due at checkout via our secure methods.
  • You must provide accurate, current billing/shipping details and update them promptly.
  • We reserve the right to limit quantities per person/household/order.

4. Delivery and Risk

  • Delivery times are estimates; we are not liable for delays beyond our control (e.g., carrier issues).
  • Risk passes to you on delivery.
  • Title passes when we receive full payment.

5. Returns, Refunds, and Faulty Goods

  • See our Returns Policy for full details, including change-of-mind returns (voluntary 30 days), statutory cancellation (14 days), and faulty goods remedies.
  • For faulty/not-as-described goods: Contact us; we cover reasonable return costs and provide repair/replacement/refund per CRA.
  • Sale items follow the same statutory rules if faulty.

6. Product Information

  • We make reasonable efforts to describe products accurately (including colours), but monitor colours may vary.
  • Descriptions/pricing may contain errors; we may correct them or cancel orders without liability (except statutory rights).

7. Your Use of the Site

  • You must be at least 18 or have parental consent if under age of majority.
  • Do not use the Site for illegal purposes, transmit viruses, or infringe rights.
  • You may not copy, reproduce, or exploit any part of the Site without our written permission.

8. Intellectual Property

  • All content on the Site (text, images, logos) is our property or licensed to us. You get a limited licence to view/use for personal shopping only.

9. Third-Party Links and Tools

  • Links to third-party sites/tools are provided "as is". We are not responsible for their content, accuracy, or your use.

10. SMS Marketing Communications

  • We only send promotional or marketing text messages (SMS or MMS) to individuals who have given their prior explicit consent in line with the Privacy and Electronic Communications Regulations 2003 (PECR) and UK GDPR.
  • By voluntarily providing your mobile phone number and expressly opting in (for example, by ticking a dedicated unchecked checkbox at checkout, on a signup form, via a keyword opt-in such as texting a short code, or through another clear affirmative action), you consent to receive recurring automated and/or non-automated marketing and informational text messages from The Needle Store.
  • These messages may include promotions, exclusive offers, discounts, product updates, cart reminders, order-related information with promotional elements, and other marketing content.
  • Messages may be sent using an automatic telephone dialling system or other automated technology. Message frequency varies depending on your interactions and our campaigns.
  • Message and data rates may apply, depending on your mobile network provider and plan.
  • Consent to receive SMS marketing messages is entirely voluntary and is not a condition of purchasing goods or using our services.
  • You can withdraw your consent (opt out) at any time without affecting your purchases or account. To opt out, simply reply STOP to any marketing text message we send you (standard network messaging rates may apply for your reply). You will then receive a confirmation that you have been unsubscribed.

  • We comply with PECR, UK GDPR, and all other applicable UK laws regarding electronic marketing.
  • This section does not affect your statutory rights under UK consumer law.

11. Limitation of Liability

  • We provide the Site and products "as described" but do not exclude liability where law prohibits it (e.g., death/personal injury from negligence, fraud, or statutory rights under CRA/CCR).
  • Subject to the above, our total liability for any claim is limited to the price you paid for the product(s) in question.
  • We are not liable for indirect/consequential losses (e.g., lost profits, data) unless caused by our negligence.

12. Indemnity

  • You indemnify us against losses from your breach of these Terms or violation of law/third-party rights (limited to reasonable, direct losses).

13. Changes to Terms

  • We may update these Terms; continued use after posting constitutes acceptance. Check periodically.

14. Termination

  • We may suspend/terminate access if you breach these Terms.
  • Obligations before termination survive.

15. Governing Law and Jurisdiction

  • These Terms are governed by the laws of England and Wales.
  • Disputes are subject to the non-exclusive jurisdiction of English courts (you may also bring claims in your home court if consumer rules allow).

16. Severability

  • If any provision is invalid, the rest remain enforceable.

17. Entire Agreement

  • These Terms (plus linked policies) form the full agreement.
